MEMORANDUM OF UNDERSTANDING ISSUED AT THE END OF A MEETING HELD AMONG THE LEADERSHIP OF TRADE UNION CONGRESS (TUC), NIGERIAN LABOUR CONGRESS (NLC) AND THEIR TWO AFFILIATES, CONSTRUCTION & CIVIL ENGINEERING SENIOR STAFF ASSOCIATION (CCESSA) AND NATIONAL UNION OF CIVIL ENGINEERING CONSTRUCTION, FURNITURE AND WOOD WORKERS (NUCECFWW) ON WEDNESDAY 21st SEPTEMBER, 2022.

Following exhaustive deliberation among parties on the current industrial crisis which led to the stoppage of Construction activities by National Association of Plants Operators (NAPO) in the NLNG Train 7 projects in Bonny Island, the following resolutions were reached Between the Leadership of Trade Union Congress of Nigeria (TUC), Nigerian Labour Congress (NLC) as represented by their two affiliates Construction & Civil Engineering Senior Staff Association (CCESSA) And National Union of Civil Engineering Construction, Furniture And Wood Workers (NUCECFWW), at the TUC National Headquarters, 47 Yakubu Gowon Crescent Asokoro District, FCT Abuja, today 21st September, 2022 as follows:

1. That CCESSA which is an affiliate of TUC and NUCECFWW which is an affiliate of NLC are the Registered Trade Union under the Trade Union Act recognized to organize or negotiate on behalf of workers in the Construction and Wood Industry in Nigeria.

2. It was further agreed that all workers who are defined as senior staff should be recognised and organized by CCESSA. While all those other workers who are defined as junior staff should be recognised and organised by NUCECFWW.

3. That any unregistered union NAPO inclusive, should desist forthwith from any action capable of causing a breach of industrial peace in Daewoo Engineering Construction Nigeria Limited (DECN) and other participating companies in NLNG Train 7 project, Bonny Island, Rivers State.

4. That any Association not Registered as a Trade Union by the Registrar of Trade Unions, cannot enter into negotiation of salary/condition of service and collective Bargaining on behalf of the workers with participating companies involved in NLNG Train 7 project.

5. Arising from the current industrial action organised by NAPO, all workers already victimized or sacked should be recalled immediately. It was further agreed that no workers as a result of his participation in the industrial action, shall be victimised or dismissed by the Management of NLNG Train 7 projects, Bonny Island, River State.

6. This Memorandum of understanding is entered with in good faith in the overall interest of the CCESSA/ NUCECFWW and Workers of NLNG Train 7 projects.
